Assessment Information This assignment is an individual assignment. This assignment requires you to answer the following questions: 1. Your client, Cats and Dogs Veterinary Hospitals (C&D vet) intends to import 3000 fridges that have the correct technological specifications necessary for the storage of surgical equipment, from its supplier Sam Fridges Ltd based in the USA sold at £1000 each. Advise C&D vet on the advantages and disadvantages of choosing CIF and FOB contracts for the transportation of their goods. (1000 words) [50 Marks available] 2. C&D vet intends to use letter of credit to make payment.To ensure your client is fully aware of what this means, advice C&D vet on the doctrine of strict compliance and the principle of autonomy in a letter of credit contract. (700 words) [35 Marks available] 3. Based on your own legal expertise, advice C&D vet on what you would consider the best dispute resolution mechanism to resolve any dispute that may arise in the transaction. (300 words) [15 Marks available] 100 marks available in total Criteria for Assessment Ensure: • You support your answer with the relevant legal authority including case law & academic commentary. • You critically evaluate the key concepts and principles relating to international salesincluding CIF, FOB, letters of credit and dispute resolution. • You correctly and accurately apply the relevant statutory provisions and case law. • Your answer has a good logical structure, as well as it is well written and well presented. • All materials used to support the answer should be well referenced. This assignment is designed to assess learning outcomes: • Critically analyse and evaluate the different types of international sales contracts; • Critically evaluate the fundamental differences between the different forms of carriage of goods by sea; • Critically review and evaluate information in order to advise and exercise judgment in problem scenarios concerning international sales disputes; • Critically analyse the rules of private international law jurisdiction to resolve international sales disputes as well as evaluating new information regarding private law jurisdiction Word Count The total word count is 2,000 There will be a penalty of a deduction of 10% of the mark (after internal moderation) for work exceeding the word limit by 10% or more. The word limit excludes footnotes and the bibliography. How to submit your assessment The assessment must be submitted by 18:00Friday 9thApril 2021. No paper copies are required. You can access the submission link through the module web. • Your coursework will be given a zero mark if you do not submit a copy through Turnitin. Please take care to ensure that you have fully submitted your work. • Please ensure that you have submitted your work using the correct file format, unreadable files will receive a mark of zero. The Faculty accepts Microsoft Office and PDF documents. • All work submitted after the submission deadline without a valid and approved reason (see below) will be given a mark of zero. • The University wants you to do your best. However, we know that sometimes events happen which mean that you can’t submit your coursework by the deadline – these events should be beyond your control and not easy to predict. If this happens, you can apply for an extension to your deadline for up to two weeks, or if you need longer, you can apply for a deferral, which takes you to the next assessment period (for example, to the resit period following the main Assessment Boards). Self-plagiarism or reuse of work previously submitted You must not submit work for assessment that you have already submitted (partially or in full), either for your current course or for another qualification of this and any other university, unless this is specifically provided for in your assignment brief or specific course or module information. Where earlier work by you is citable, i.e. it has already been published/submitted, you must reference it clearly. Return of Marked Work You can expect to have marked work returned to you within 10 working days following the submission deadline. If for any reason there is a delay you will be kept informed. As always, marks will have been internally moderated only, and will therefore be provisional; your mark will be formally agreed later in the year once the external examiner has completed his / her review.
