Assignment Instructions/ Description
Case Briefing: Students will be instructed to search the Internet for a reported case on a particular type of crime and to brief the case based on the facts presented. The brief will include the elements of the crime, defense strategies, Constitutional issues involved, and a summary of the trial facts. Students will also assess the trial outcome. The brief will be supported by course materials and outside resources. Case Analysis Details: You are free to select any case that you like. However, the case must have been adjudicated at trial that means, a verdict must have been decided. You cannot perform a case analysis on an ongoing criminal investigation or prosecution. If your case analysis is based on a case that has not been adjudicated, it will not be considered for grading. Obviously some cases may be in the appeal process, but that aspect of the adjudication should not be addressed in your paper.I would caution you against performing a case analysis on cyber-crime. Cases like that can be very complicated and the possible defenses to a cyber-crime are limited. So, I recommend that you plan to perform your case analysis on a murder, or other violent crime. The form is what you did for Project Two. Meaning, a memo format. Your first paragraph should detail the facts of the case and the end should depict your conclusion which is based on only the facts measured against the law. Your narrative should be well organized and written in such a way that a first time reader can grasp a complete understanding of the case and what your conclusion is based on. Do not write the narrative as one long paragraph. There are logical breaks in any legal memo and I will leave it up to you decide where those logical breaks should be. You must also include a list of all references. The paper should be written in New Times Roman 12 pitch font and single-spaced.
