Our legal system was established to allow people to determine right and wrong mostly for themselves as long as they respected others' right to do the same. Given the increasing complexity of society and the greater interdependence of actors, the law has increasingly taken over the role of establishing moral norms, and that in itself has become an area of significant dispute.
From a business perspective, should we allow businesses to act in whatever ways management determines is appropriate in the circumstance without legal interference and let market forces decide what is "right" or "wrong"? Increasingly, laws require people to act in a certain way, according to certain moral norms. Do you believe the law should fill this role?
Business is subject to lawsuits, but where can those lawsuits be filed? Jurisdiction determines this and is a strategy from where business operates. As you read this chapter, think about global organizations and how a lawsuit would be filed or settled if the lawsuit pertained to acts committed abroad.
Think about how Alternative Dispute Resolution (ADR) fits into today's litigious society. With that in mind, how can you reconcile traditional litigation with ADR?
As you read this chapter, think about how international law could affect how you would conduct a global business in the international marketplace and how you would manage the risk created.
Think about how law impacts virtually every aspect of your life, including your ability to protect your ideas.
How far should the law extend as it relates to protecting those ideas and your ability to create things?
